Legal aid is a government fund that pays for defense and representation in certain criminal cases.
Legal aid is granted to defendants based on their financial circumstances and the crime they are charged with.
The Legal Aid Agency takes the following factors into consideration when determining eligibility for the benefit.
Family Income: The Legal Aid Agency assesses whether to fully or partially fund your defense by analyzing your personal and family income.
Factors such as income, family circumstances, such as the number of children, and essential expenses, such as mortgage or rent, are compared.
Admissibility also depends on the title of the crime and the type of court before which the trial is held.
Interest of justice: The granting of legal aid must also pass the test of the interest of justice by analyzing certain elements of the specific case such as the nature of the crime, the probability of conviction with a custodial sentence and the criminal record of the applicant.
Exceptions: There are circumstances where the defendant is automatically eligible for legal aid, regardless of the assessment of income and the factors mentioned above.
Such exceptions are known as “passporting”. Applicants who automatically pass the means test are those in receipt of Income Support, Income based job seekers allowance, Income based Employment and Support Allowance or Guarantee State Pension Credit.
